OT - I'm Being Sued!

I would support a countersuit. literaly, with money. The bothey band members could make millions from these freaks if this is a valid suit. I listened to metallica all through my youth. I will never pay for a single tune of theirs now. I might send four figures to anybody that sues them for dammages. All I'd ask is for my money back. Those F**kers have been STEALING from classical composers for years (decades now). I don't think they have an original tune in their brains at this point. All they do is steal steal steal.
Anything that takes money away from them and helps traditional music is a good thing in my book. They must othe the clancy brothers $200 million by now by their theivery of "Whisky in the Jar"

Scarborough Fair isn't entirely copyrighted. The verses are found in some editions of Mother Goose, and are an old ballad, well within the public domain. You would need permission to use a copyrighted arrangement, however. Seriously, I was under the impression that if you weren't making money with someone else's tune/material then you couldn't get sued?

No, singing a song in private doesn't violate copyright. But if you made copies, without permission, and gave them out for free, that would violate copyright. And it would also violate copyright if you performed it on the air, not for profit, without securing copyright permission. The copyright office has a web site that explains all of these issues. What I heard was that Simon and Garfunkle went and copyrighted an arrangement of it they got from Martin Carthy (who is infinitely cooler than them), but he sued them and won.
