Why was I not suprised? I was playing my whistle at the trolley stop, and a woman stomped out of the tourist information booth and said "Free music? We can't have that in Deadwood! I had to call the cops!" And a cop car pulled up beside me where I was sitting. They decided I wasn't doing anything illegal, playing pourely for self-satisfaction, but warned me not to busk, because they would bust me under a catch- all soliciting law. Oy-freekin-Vey!

You probably look like one o' them hippie homeless freaky types. (Just kidding)

That is, of course, why they enact such laws - to keep beggars out. Personally, I don't have any problem with someone playing for tips - just with their playing badly for tips.

Hey, maybe that's what I should do in my retirement - offer my services to the local constabulary as the buskers' music critic.

Geeze, didn't think looks had anything to do with anything, maybe if I send Sofia Loren out with a whistle in hand and hid behind the post and played while she did a karoke thing...but yeah, the city tries really hard to keep out anybody but people who compulsively play the slot machines, which I don't!

Anna,

Back in the 60's, Peter, Paul and Mary did a song called "The Talkin' Candy Bar Blues Song" that tells a satirical tale built around an innocent gift of candy to a kid. Maybe you should write a song about the "Free Whistler of Deadwood". Kind of like, South Dakota meets Alices Restaurant.

Something satisfying knowing simular behaviors by the Deadwood artistically challenged will just reinforce your song and actually help your to ...

I'm sure 'dancing' is right-out in deadwood. Sounds like a great place to write a screenplay for "Footloose 2:the Curmudgeouns Revenge"

The 'Clare' and other two-piece whistles, are often promoted (by people like me) with slogan such as: 'great for taking with you on the train/bus/out walking' and 'playing at the bus stop etc etc.' I didn't realise I was inciting people to break the law!

There is a guy who stands outside the most popular place for tourists in my small village, from 8am to 6pm almost every day, busking with a guitar. No one stops him (and there are plenty who could.) In fact they usually throw him money! The difference is in this case - you weren't actually busking. Perhaps the lady felt you were causing noise pollution? Perhaps you were disturbing her dog due to its sensitive hearing? Perhaps she's just an old grumpy boots!

There is a serious issue here, too, I think. Are we only allowed to play music in sound-proofed rooms! If so, what about outdoor concerts?

Steve, the acoustics in Deadwood are marvelous. The sound of the whistle bouncing off the cliffs of the gulch is amazing. Maybe it's the red wing blackbirds those pure tones attract? I've never been crapped on by one, but they sure take off when you hit a sour note. Any sane whistler would love playing here!

Of course, the city's attitude boggles the mind, as does their shoot us in the collective foot politics.

There are no laws about giving music away for free, it is simple harrassment by the same folks who ran Wild Bill Hickok out of town last summer. His murder here in 1876 has been generating revenue ever since then! They also outlawed gunfights in the streets, which was a real shoot yourself in the foot tactic. It was one of the few things here that families could enjoy together.

Gotta love those duets with howling dogs, though, great fun when you get the whole main street full of them howling, but then again, these cowboys tend to leave their dogs in the back of their pick-up trucks while they go gamble, and they have leash laws here, but the cowboys generate revenue for the city by compusively throwing their nickles, quarters and five dollar bills at the slot machines and poker tables.

Us musicians around here have discovered that Deadwood alone will not support the arts, as the casinos don't want us around as we will not give then our laundry money. The Black Hills area will support us, however. What's really ironic, is that when people do give me money, it's usually Native Americans, who by and large, don't have squat to give away. Yesterday, a woman handed me a handful of change just because she said she liked the music, and I had a bit of a time accepting it, and I was not soliciting...no jar, no open guitar case, just me and my whistle looking like happy buddah.

There are some serious First Amendment rights at issue here. Because we are a unique music community here, many of us are putting over 18,000 miles on and spending God knows what on gas to trek around the hills just to make music together. As a group, we're pretty powerless, as there are no influential citizens of Deadwood in the group and the influential jackA$$es don't like musicians.
We call Deadwood "Scooptown" likethey did in the old days, because the second you hit main street, somebody's gonna put their hands in your pcoket and scoop out your money one way or another.

The new Black Hills Musicans Guild will not tackle anything like advocating for musicians, but one venue owner has said he will introduce a measure to the city council proposing that the city issue a license and allow busking. Since he is a business owner, they might consider it. This is the guy who would at least feed us at his restaurant for doing open mikes.

Us tramps and hawkers just don't have a chance, even with a state assemblyman who just happens to play acoustic Kiss advocating for freedom to play! Deadwood hasn't changed since 1876, other than having indoor bathrooms...but maybe...
